Case from 2017–2019 (U.S. Attorney's Office release: March 22, 2017; later developments are from court records and other sources cited below). Published on Scammers.com Oct. 16, 2026; case status is current as of that date.
Henry Posada, a chiropractor whose clinic, Associated Back Care and Rehabilitation, operated in Chicago's West Lawn neighborhood, was indicted in March 2017 on 18 counts of health care fraud. Prosecutors alleged he submitted at least $10 million in claims to Medicare and private insurers for services that were never provided [1].
Outcome: A jury found Posada guilty on all 18 counts in October 2017 [2]. The district court found a loss of $4,087,736 and sentenced him to 60 months in prison. The U.S. Court of Appeals for the Seventh Circuit affirmed the sentence on July 18, 2019 [3], and the U.S. Supreme Court denied review on Nov. 18, 2019 [4].
How the scheme worked
According to the indictment, as described by prosecutors [1]:
- Phantom treatment: Posada submitted claims for physical therapy and chiropractic services that were never provided.
- Out of state: In some instances he was out of Illinois on the dates he claimed to have treated patients.
- Borrowed names: At other times he used patients' names without their knowledge to create entirely fictitious claim forms.
- The money: From 2008 to 2016, the claims totaled at least $10 million and caused Medicare and private insurers to pay at least $5.1 million to Posada and his clinic, Spine Clinics of America S.C., which did business as Associated Back Care and Rehabilitation, in the 4300 block of West 63rd Street.
The Chicago Tribune reported that the programs billed included Medicare, Cigna, Independence Blue Cross, Blue Cross Blue Shield of Illinois, the National Association of Letter Carriers health plan and Humana [2].
The person charged
Henry (Enrique) Posada, of Clarendon Hills, Ill. (54 when indicted)
- Indictment (March 16, 2017): 18 counts of health care fraud. He pleaded not guilty before U.S. District Judge Edmond E. Chang. The indictment sought forfeiture of $5.1 million, $850,000 in cashier's checks, a 2013 Lexus LX 570 and a property in Watseka, Ill. [1]
- Verdict (Oct. 27, 2017): guilty on all 18 counts after a jury trial [2].
- Sentence: 60 months in prison, with a loss amount of $4,087,736, according to the Seventh Circuit [3]. The docket shows the sentencing hearing on Feb. 13, 2018, and judgment entered Feb. 26, 2018 [5].
- Appeal: Posada argued the loss calculation was clearly erroneous. The Seventh Circuit disagreed and affirmed (No. 18-1586) [3]. The Supreme Court denied certiorari on Nov. 18, 2019 (No. 19-499) [4].
- Investigation: FBI Chicago and the HHS Office of Inspector General, with help from the U.S. Office of Personnel Management's Office of Inspector General [1].
Red flags
- Explanation-of-benefits statements or Medicare Summary Notices listing visits or therapy you never received.
- Claims dated on days you were not at the clinic.
- A provider who asks for your insurance card "for the file" when you aren't being treated.
What to do if you're targeted
- Review every EOB and Medicare Summary Notice and compare it with your own appointment record.
- Report suspicious Medicare billing to the HHS-OIG hotline at 1-800-HHS-TIPS, and private-insurance billing to your insurer's fraud unit.
- Ask your insurer for a claims history if you think someone is billing under your name.
