Jacinto "John" Gabriel Jr., a Chicago man who took control of two home health companies and used them to bill Medicare for more than $20 million, was sentenced on April 17, 2015, to 120 months in federal prison, the U.S. Attorney's Office for the Northern District of Illinois announced [1]. U.S. District Judge Charles Norgle ordered him to pay $23.3 million in restitution to Medicare and $1.5 million to the IRS.
How the scheme worked
According to Gabriel's guilty plea and government sentencing papers, as described by prosecutors [1]:
- Harvesting patient data: Gabriel fraudulently obtained confidential background information on hundreds of Medicare beneficiaries and signed them up as patients of Perpetual Home Health Inc. and Legacy Home Healthcare Services, companies he controlled.
- Fake diagnoses: Patients were deliberately misdiagnosed with conditions they didn't have so Medicare could be billed for treatment they didn't need. "Gabriel used elderly patients as commodities to bill Medicare," the government wrote.
- Doctored records and payoffs: He admitted directing staff to alter and create patient records and doctors' orders, and paying doctors and others for referrals and for signing orders.
- Hiding the money: He admitted funneling proceeds to himself through friends, associates and shell companies.
Gabriel was charged with 11 other defendants, including doctors and company employees, according to the release.
