Pennsylvania Attorney General Dave Sunday announced on Oct. 15, 2026, a lawsuit against western Pennsylvania men Sean Walters and Charles Spencer and several affiliated businesses over a rent-to-own scheme in which the defendants allegedly “sold” homes under land installment contracts without owning them [1]. Allegheny County Common Pleas Court granted an ex parte preliminary injunction requiring the defendants to keep paying sellers’ mortgages and HOA fees, halting evictions and barring further encumbrances on the properties [1].
Important: This is a civil consumer-protection lawsuit. Walters, Spencer and the company defendants have been sued; they have not been convicted of a crime. The allegations are unproven unless and until a court rules otherwise.
How the alleged scheme worked
According to the Pennsylvania Attorney General’s Office [1]:
- Target sellers under pressure. The defendants sought homeowners who needed to sell quickly.
- “Purchase” by assuming the mortgage. They signed contracts to “purchase” homes by agreeing to take over the sellers’ mortgage payments.
- “Sell” to first-time buyers. They then offered the same homes to new buyers under land installment contracts (rent-to-own style deals), without disclosing that the defendants did not own the properties.
- Default and fallout. Over time they allegedly defaulted on the underlying mortgages, damaging the credit of the original sellers and leading to foreclosure and eviction proceedings against buyers who thought monthly payments were building equity.
- Two sets of victims. Sellers lost credit and faced foreclosure risk; buyers faced eviction after paying into a path to ownership that, the Attorney General alleges, the defendants could not deliver.
“These defendants made the American dream of homeownership a living nightmare for unsuspecting home sellers and buyers,” Sunday said. “The defendants were deceptive and predatory, choosing homeowners who were under pressures to move quickly” [1].
The people and companies sued
- Sean Walters of Wexford, Pennsylvania
- Charles Spencer of Cranberry Township, Pennsylvania
- CSW Financial LLC; W Group Holdings, LLC; RS Capital LLC; Marlin Holdings, LLC; Alpha Realty Investment LLC; NSX Property Group, LLC [1]
Court: Allegheny County Court of Common Pleas (lawsuit and injunction motion filed the week of the Oct. 15 announcement).
Claims: alleged violations of the Pennsylvania Unfair Trade Practices and Consumer Protection Law and the Pennsylvania Loan Interest and Protection Law, among other causes of action [1].
Relief sought: restitution for harmed consumers, penalties and related costs, plus the preliminary injunctive terms already granted.
Impacted consumers who have not yet contacted the AG’s office are asked to call 1-800-441-2555 [1].
Red flags
- A “buyer” who will only take over your mortgage payments without a conventional closing, title insurance and recorded deed.
- Land contracts or rent-to-own deals where the seller cannot produce clear proof of title.
- Pressure to move fast because you are relocating, behind on payments or a first-time buyer who has never closed a home purchase.
- Monthly payments to a private LLC rather than a licensed mortgage servicer, with vague answers about who holds the mortgage.
- Eviction or HOA threats shortly after you start paying into a land contract.
What to do if you’re targeted
- Before signing any land contract, have a real-estate attorney pull title and confirm who owns the property and who holds the mortgage.
- Sellers: do not hand over possession or stop monitoring your mortgage until a recorded deed and release are in place.
- Buyers already paying: call the Pennsylvania Attorney General at 1-800-441-2555 and preserve contracts, payment receipts and eviction papers [1].
- Report housing fraud to the FTC at ReportFraud.ftc.gov and consider a credit freeze if your mortgage credit is at risk.
