Case from 2015–2016 (U.S. Attorney's Office latest release: Nov. 8, 2016). Published on Scammers.com Oct. 16, 2026; case status is current as of that date.

Stephen C. Browere, founder of Geneva, Illinois-based Stephens Capital Management Inc., was sentenced on Nov. 4, 2016, to five years in federal prison for using client money to buy a yacht and a luxury car and to trade his own stocks, the U.S. Attorney's Office for the Northern District of Illinois announced [1]. He was ordered to pay $3.7 million in restitution.

How the scheme worked

According to prosecutors [1] [2]:

  1. "Guaranteed" notes: Browere promised lucrative, guaranteed returns to persuade clients to buy $1.66 million in promissory notes from Douglas Capital Corp. in Lisle. Many pledged life savings or retirement money.
  2. Hidden conflict: He didn't tell them a relative was Douglas Capital's president, or that he ran its daily operations and had access to its credit lines.
  3. Where the money went: He traded in his own portfolio and bought a yacht and a BMW.
  4. Ponzi-like payments: He used principal from some investors to pay interest to others.
  5. Power of attorney: He obtained power of attorney over an elderly client with dementia whose cash and property were worth more than $2.1 million, used some of it to buy four vacant lots in Lisle and pay other clients, and kept misusing the estate after the client died.

The scheme ran from no later than 2007 until about February 2014.

The person sentenced

Stephen C. Browere, 57 at sentencing, of Geneva, Ill. [1]

  • Indictment (Sept. 16, 2015): eight counts [2].
  • Plea (June 2016): pleaded guilty to one count of mail fraud.
  • Sentence (Nov. 4, 2016): 60 months in prison and $3.7 million in restitution, imposed by U.S. District Judge Matthew F. Kennelly.
  • Investigation: U.S. Department of Labor's Employee Benefits Security Administration and the U.S. Postal Inspection Service, with help from the Illinois Secretary of State's Office.

Red flags

  • "Guaranteed" high returns on notes from a small private company.
  • An adviser steering you to a company he or his family controls without disclosing it.
  • An adviser seeking power of attorney over a client, especially an older one.

What to do if you're targeted

  1. Ask in writing whether your adviser or relatives have any interest in a recommended investment.
  2. Keep powers of attorney with family or independent fiduciaries, and require periodic accountings.
  3. Report suspected adviser fraud to the Illinois Secretary of State Securities Department or the SEC at sec.gov/tcr.
