Florida Supreme Court Emergency-Suspends Fort Lauderdale Attorney for Misappropriating Escrow Funds

Escrow money held for a foreclosure lien holder is supposed to sit in trust—or go into an interpleader—not disappear into the lawyer’s use. According to The Florida Bar News’s November 1, 2024 report, the Supreme Court of Florida emergency-suspended Marc Evan Brown of Fort Lauderdale effective immediately following an October 1, 2024 order in Case No. SC2024-1394 [1].

According to The Florida Bar News [1]:

1. Brown (admitted 2006) misappropriated client funds of at least $40,028.46 received while representing a lien holder in a foreclosure matter; he was to hold the funds in trust as escrow agent and file an interpleader if needed.
2. No funds were applied to an interpleader; he made misrepresentations to the client about the interpleader’s status and failed to produce all required subpoenaed trust records.
